High Court requests response on Kejriwal's petition from ED: The court asked CM, who had contested the summons, "Why don't you appear?"
Following many summonses to Chief Minister Arvind Kejriwal, the Delhi High Court issued a summons to the Enforcement Directorate (ED). ED has been allowed two weeks by the court to make its case.
Kejriwal's attorneys were also questioned by the bench, which was made up of Justices Suresh Kumar Kait and Manoj Jain: "Why don't you (Kejriwal) appear before the ED?" It is simply a summons in name; you are a citizen of this nation.
In response, AAP leaders Manish Sisodia and Sanjay Singh were taken into custody by the ED, according to the CM's attorneys, Abhishek Manu Singhvi and Vikram Chaudhary. They worry that Kejriwal may also be arrested by the ED. Kejriwal will show up if he is granted security. The following hearing on this case is scheduled for April 22.
To date, the ED has issued ten summonses to Kejriwal.
In reality, on March 17, the ED served Kejriwal with the ninth summons in the Delhi Liquor Policy case. He was scheduled to appear on March 21 for PMLA questioning. On March 19, Kejriwal appeared in the High Court in opposition to the summons.
Kejriwal was summoned by the ED in the Delhi Jal Board tender case in addition to the liquor policy issue. In this instance, the Delhi CM has received a summons for the first time. On March 18, he was scheduled to be questioned over the Water Board case, but he chose not to attend.
Kejriwal received summonses in the liquor policy matter on February 27, 26, 22, February 2, February 17, January 3, and December 21 and November 2, 2023. But he never once went to be questioned.
AAP deemed ED's summons to be unlawful.
Following Kejriwal's non-appearance on March 18 in the Delhi Jal Board matter, the AAP claimed that the ED's summons was unlawful. The AAP questioned why the CM was receiving summonses on a regular basis after receiving temporary bail from the court. The AAP claims that Kejriwal is the target of the BJP's ED campaign.
CM Kejriwal may be arrested by the ED if he fails to show up for work on a regular basis. An arrest warrant may be issued against him. Section 45 allows for the issuance of a non-bailable warrant even after that if he does not show up.
According to experts on the Prevention of Money Laundering Act (PMLA), the ED may extend the deadline if a specific explanation is provided for the absence. Then it sends out another notification. If a notice is repeatedly ignored under the PMLA, arrest may result.
The investigating officer may visit the home and question CM Kejriwal if he does not show up again. If there is sufficient proof or no suitable response to the inquiries, they may be taken into custody.
In addition, Kejriwal has the option to appear in court after the warrant is issued and swear to assist with the inquiry while his attorney is present. A judge may order the ED not to make an arrest based on this.
